Terms of Service

These Terms of Service govern the use of whacl, a platform operated by HEBER HOST ("we", "us"), by a business ("you", "the business") to manage WhatsApp, Instagram, and Facebook conversations through an AI assistant and dashboard.

1. The service

whacl connects your WhatsApp Business number (and optionally Instagram and Facebook) to an AI assistant that replies to your customers, plus a dashboard to review conversations, leads, and campaigns. We handle the underlying Meta API connection and business verification on your behalf.

2. Accounts and workspaces

Your business gets its own workspace with its own separate database, reachable at its own address. You are responsible for the accounts you create in it, for keeping login credentials confidential, and for everything done under those accounts. Tell us immediately if you believe an account has been compromised.

3. Your responsibilities

  • You must own or have authorization to use the phone number and business accounts connected to whacl.
  • You are responsible for the accuracy of the catalog, pricing, and policy information you provide the assistant.
  • You are the data controller for your customers' conversations. You decide what the assistant says, who on your team can read them, and you answer your customers' data requests — we act on your instructions and will help you respond.
  • You are responsible for complying with the privacy and consumer laws that apply to your own business and customers.

4. Acceptable use

You agree to use whacl in line with Meta's WhatsApp Business Messaging Policy, Messenger and Instagram platform policies, and commerce policies. In particular:

  • No unsolicited bulk messaging. Template campaigns may only be sent to people who have contacted your business or otherwise opted in, and every campaign must honour opt-out requests.
  • No uploading of purchased, scraped, or third-party contact lists.
  • No unlawful, deceptive, or prohibited content, and nothing that impersonates another business or person.
  • No attempt to access another business's workspace or data, or to probe, disrupt, or reverse-engineer the platform.

Breaking these rules is what gets a phone number restricted by Meta, and repeated across the platform, the whole app. We take it seriously.

5. AI-generated replies

Replies are generated automatically from the information you provide. You can review, correct, or take over any conversation at any time. We are not liable for a specific AI-generated reply's content beyond providing the correction and handoff tools to fix it going forward.

6. Data

Conversation data belongs to your business. We process it to provide the service — generating replies, storing history, and showing your dashboard — and do not sell it, share it with advertisers, or use one business's data to serve another. 7. Billing

Pricing is agreed with each business individually based on message volume and channels, communicated before the service goes live. There is no long-term contract — either party may end the arrangement with notice. Meta charges its own messaging fees for WhatsApp conversations, separately from anything we bill.

8. Availability

We aim for high availability but cannot guarantee uninterrupted service, since whacl depends on Meta's WhatsApp, Instagram, and Facebook platforms and on Anthropic's Claude API remaining available.

9. Suspension and termination

We may suspend a workspace without notice if it breaks Section 4, puts the platform's Meta access at risk, or goes unpaid. Either party may terminate with notice. On termination you can request an export of your conversation data, after which the workspace and its database are deleted within 30 days.

10. Intellectual property

The whacl platform, its software, and its branding remain ours. Your business content — your profile, catalog, instructions to the assistant, and conversations — remains yours. You grant us only the permission needed to host and process it in order to run the service for you.

11. Limitation of liability

The service is provided as is. To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or lost business, and our total liability is limited to the fees you paid us in the three months before the claim. Nothing here excludes liability that cannot lawfully be excluded.

12. Governing law

These terms are governed by the laws of Morocco, and disputes fall to the competent courts of Casablanca, unless mandatory consumer or data protection law in your own country says otherwise.

13. Changes

We may update these terms from time to time. The "Last updated" date above reflects the most recent revision.
